‍By downloading, accessing, or using ExamEase ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the App.

‍2. Description of the App
‍ExamEase is an exam practice application that supplies learners with past exam papers to help prepare for their mid-year and end-of-year exams.

‍3. Eligibility
‍The App is intended for use by students. By using the App, you represent that you are a student and have the legal capacity to enter into this agreement.

‍4. User Accounts:
Registration: Users must create an account to access certain features of the App. Information collected during registration includes your name, surname, email address, and phone number.
‍Third-Party Login: You may register or log in using third-party services like Google. By doing so, you authorize us to access certain account information from that third-party service.
‍Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
‍Data Removal: Users can request data removal by contacting us at support@examease.ai.

‍5. User Content
Uploads: The App allows you to upload documents and images. By uploading content, you represent that you have all necessary rights and permissions.
‍Prohibited Content: You agree not to upload content that is illegal, harmful, or violates any third-party rights.

‍6. Payments
In-App Purchases: The App offers once-off purchases for access to certain features or content.
‍No Refund Policy: All purchases are final and non-refundable. Please review your order carefully before completing any transaction.

‍7. Intellectual Property Rights
Ownership: The exam papers provided are the property of the Department of Basic Education.
‍License: We grant you a limited, non-exclusive, non-transferable license to use the App for personal, educational purposes.
‍Restrictions: You may not copy, distribute, modify, or create derivative works from the App or its content.

‍8. Prohibited Activities
‍You agree not to:
‍Misuse the App: Engage in any activity that interferes with or disrupts the App's functionality.
‍Reverse Engineering: Attempt to decipher, decompile, or reverse-engineer any of the software comprising or making up the App.

‍9. Privacy PolicyYour use of the App is also governed by our Privacy Policy, which can be found at https://privacy-policy.examease.ai/. The Privacy Policy explains how we collect, use, and disclose your personal information.

‍10. Third-Party Services
OpenAI's API: The App utilizes OpenAI's API. Your use of this feature is subject to OpenAI's terms and privacy policy.
‍No Liability: We are not responsible for any third-party services integrated into the App.

‍11. Limitation of Liability
‍To the fullest extent permitted by law, ExamEase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

‍12. Disclaimer of Warranties
‍The App is provided on an "as-is" and "as-available" basis. We make no warranties or representations about the accuracy or completeness of the App's content.

‍13. Indemnification
‍You agree to indemnify and hold ExamEase harmless from any claims, losses, liabilities, damages, expenses, and costs arising out of your use of the App or violation of these Terms.

‍14. Governing Law
‍These Terms are governed by the laws of South Africa, without regard to its conflict of law principles.

‍15. Dispute Resolution
‍Any disputes arising from these Terms or the App will be resolved through binding arbitration in accordance with the rules of the South African Arbitration Association.

‍16. Changes to Terms
‍We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App. Your continued use of the App constitutes acceptance of the revised Terms.
